These Terms govern your use of the xofoundry website and your purchase and use of digital font products, including Zyrian Obelisk. The provider and licensor is:

Any product-specific terms shown on the product page, at checkout, or included with the download form part of these Terms. If they conflict with these general Terms, the product-specific terms prevail.

Purchases are completed on Gumroad. Gumroad acts as the merchant of record, processes payment, collects and remits applicable sales taxes, and provides the receipt and download link. The price, supported payment methods, taxes, and order summary displayed by Gumroad at checkout apply to your purchase.

Gumroad's own terms and privacy policy also apply to its checkout and payment services. We do not receive or store your full card or bank details.

A contract is formed when Gumroad accepts your order and confirms the purchase. You must provide accurate checkout information and be legally capable of entering into the transaction.

Unless a product page or license file states otherwise, a completed purchase grants the purchaser a perpetual, worldwide, non-exclusive, non-transferable license to use the supplied font software in personal and commercial design work.

Permitted use

• Install the fonts on devices used by the purchaser.
• Create print, packaging, branding, logos, editorial work, social media, still images, and moving-image work.
• Convert typeset text to outlines or raster images and modify those shapes as part of a finished design.
• Self-host the supplied webfont files on websites owned or controlled by the purchaser.
• Create work for clients, provided the client receives only finished artwork or outlined text. A client who needs the font files or will host the webfonts must obtain its own license.

Not permitted

• Share, sublicense, sell, rent, publish, or otherwise distribute the font files.
• Upload the font files to a public repository, shared asset library, design template, print-on-demand service, or other service that lets third parties extract or reuse them.
• Modify, rename, reverse engineer, convert, or create a derivative font for distribution, except where mandatory law expressly permits this.
• Use the font files as the principal content of an app, editable product, or template that allows end users to typeset with the font without our prior written permission.

In short: use the typeface freely in finished personal and commercial work, but do not pass on the working font files.

Digital products are delivered through the download link in your Gumroad receipt. You are responsible for providing a working email address and retaining your receipt or a backup of the downloaded files.

Where the product page promises free updates, updates that we release for the purchased version will be made available without an additional license fee. This does not promise a particular release schedule, new features, or continued development of a product.

If you are a consumer, mandatory consumer protection law applies. For digital content, a statutory right of withdrawal may expire once delivery begins if you have expressly consented to immediate performance and acknowledged that this causes the withdrawal right to expire. Any required consent and checkout information are presented during the Gumroad purchase flow.

If a file is defective, incomplete, or materially different from its description, contact us or Gumroad with the purchase details. We will provide a corrected file, replacement download, or another remedy required by law. Refund handling may be carried out through Gumroad. Nothing in these Terms limits mandatory rights relating to defective or non-conforming digital content.

The font software, website, specimens, text, and original artwork remain protected by copyright and other intellectual property rights. Buying a font grants only the license described above. It does not transfer ownership of the font software or the xofoundry name and visual identity.

You retain all rights in original work you create with the fonts, subject to the rights in the underlying font software.

You may browse and use this website for lawful purposes. You must not interfere with its operation, attempt unauthorized access, introduce malicious code, or use automated means that place an unreasonable load on the site.

The website links to services and sources operated by third parties, including Gumroad. We do not control their availability, content, or data practices. Their own terms apply when you use them.

We may update, correct, suspend, or discontinue website content and products. We do not promise uninterrupted website availability.

We are liable without limitation for intent and gross negligence, injury to life, body, or health, fraudulent concealment, guarantees expressly given, and liability under the German Product Liability Act.

For slight negligence, we are liable only for breach of an essential contractual obligation and only for typical, foreseeable damage. An essential obligation is one whose performance makes proper fulfilment of the contract possible and on which you may normally rely. Mandatory consumer rights remain unaffected.

We may update these Terms for future visits and purchases to reflect changes in products, services, or law. The version in effect when you purchase continues to govern that purchase unless a change is required by law or is expressly agreed with you.

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of mandatory protections under the law of the country in which you habitually reside.

If you are a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction is Düsseldorf, Germany. Otherwise, statutory jurisdiction rules apply.
